Legislative and Regulatory Reform Act 2006 (c.51) OPSI - Legislative and Regulatory Reform Act 2006 (c.51)
Amends:Regulatory Reform Act 2001 (C. 6)
Amended by:Government of Wales Act (Executive Powers) 2006 (C.32)
 
to enable provision to be made for the purpose of removing or reducing burdens resulting from legislation and promoting regulatory principles; to make provision about the exercise of regulatory functions; to make provision about the interpretation of legislation relating to the European Communities and the European Economic Area; to make provision relating to section 2(2) of the European Communities Act 1972; and for connected purposes.  

Functions exercisable solely by WAG or the National Assembly for Wales.

The following Ministerial powers are exercisable by the Welsh Ministers in relation to Wales:

Part 2: Regulators:

  • section 24: Power to specify the regulatory functions exercisable only in or as regards Wales as functions to which sections 21 and 22 apply (duties of proportionality, transparency etc.). Power of Assembly to approve draft SI.

Part 3: Legislative Relating to the European Communities Etc.

  • section 27: Where any enactment passed, or subordinate legislation made, before the coming into force of this section refers to regulations under subsection (2) of section 2 of the European Communities Act 1972, the Welsh Ministers, so far as exercisable in relation to a matter in respect of which functions are exercisable by the Welsh Ministers, shall also be exercisable by the Welsh Ministers, may by order or regulations amend the enactment or subordinate legislation so that it includes a reference to any order, rules or scheme under that subsection.
The following Ministerial powers are exercisable by the Assembly in relation to Wales:
  • section 4(5A)(b): Power to approved draft SI made under this section
The following Ministerial powers are exercisable by the Welsh Ministers, First Minister or Counsel General in relation to Wales:
  • section 27(5): Power to make orders or regulations, within their functions, amending enactments made before the coming into force of the 2006 Act which refer to section 2(2) of the European Communities Act 1972.
The following Ministerial powers are exercisable by the Assembly in relation to Wales:
  • section 24(9A): Power to approve draft SI.
