The following Ministerial functions are exercisable by the Welsh Ministers in relation to Wales: ALL THE SIS MADE UNDER THIS ACT ARE SUBJECT TO ANNULMENT BY THE ASSEMBLY with few exceptions. See section 203 below. Part 1: Promotion and Provision of the Health Service in Wales: - section 1: Duty to promote in Wales of a comprehensive health service designed to secure improvement- in the physical and mental health of the people of Wales, and in the prevention, diagnosis and treatment of illness. Duty to provide or secure the provision of services in accordance with this Act.
- section 2: General power to provide health services.
- sections 3 to 5 and Schedule 1: Duty to provide some particular services which include for example high security psychiatric services, hospital accomadation, dental, ophtalmic or ambulance services.
- section 6: Powers in very limited cases to provide services outside of Wales.
- section 7: Power to determine disputes arising from NHS contracts or their negociations. Power to delegate that power. Power to determine the terms which have to be included in such contract including a power to issue directions. Power to vary the term of the arrangement or to stop it.
- section 9: Power to prescribe other health service bodies deemed to enter in NHS contracts.
- section 10: Power to delegate powers to other bodies so that they provide or assist in providing health services.

- section 29: Duty to execrise health bodies' functions when body ceases to exist to deal with its liabilities. Power to transfer liabilities to an NHS body, the Welsh Ministers or the Secretary of State.
- section 30: Power by regulations to establish a scheme whereby any of the bodies specified in subsection (2) may make provision to meet- expenses arising from any loss of or damage to their property, and liabilities to third parties for loss, damage or injury arising out of the carrying out of the functions of the bodies concerned.

- section 78: Power to decide when LHBs are required to consult Local Optical Committees.
- section 79: Power to make available accomodation for the provision of GOSs.

- section 114: Power to make regulations providing for the payment of practioners who have had a successfull appeal to the FHSAA against the decision that they are suspended.
- section 115: Power to change the period for a review of a national disqualification.
- section 116: Power to prescribe the persons to be notified by the LHBs of decisions made under this Chapter and the information to be accompanying such notifications.
- section 117: Power to prescribe the circumstances in which a practitioner may not withdraw from a list in which he is included.
- section 118: Power to make regulations as to how LHBs' decisions may be reached under this Chapter.
- section 119: Power to decide that a corresponding decision made in Scotland or Northern Ireland applies to Wales.

- Schedule 8, paragraph 3: Duty to apportion among all Local Health Boards, in such manner as they consider appropriate, the total of the remuneration referable to the cost of drugs which is paid by each Local Health Board in that year. Power to make provision for any remuneration referable to the cost of drugs which is paid by a Local Health Board other than the Board which is accountable for the payment to be reimbursed in such manner as the Welsh Ministers may determine.
- Schedule 8, paragraph 4: Duty to determine what remuneration paid by Local Health Boards to persons providing pharmaceutical services or local pharmaceutical services must be treated for the purposes of this Schedule as remuneration referable to the cost of drugs. Power to treat all remuneration paid by Local Health Boards to such persons, so far as it is met by an NHS trust under section 180(4), as remuneration referable to the cost of drugs for those purposes.

Schedule 9: Accounts and Audit: (See also Shared powers). - Schedule 9, paragraph 5: Duty to prepare summarised accounts relating to such bodies in respect of each financial year. Duty to transmit the summarised accounts to the Auditor General for Wales not later than the end of the month of November following the financial year to which they relate.

Schedule 10: Further Provision about Community Health Councils: - Schedule 10, paragraph 1, 2, 3, 4 and 5: Very wide powers to regulate of asects of Community Health Councils, including example their functions, staff, proceedings, reports, their relationship with other public bodies and for them to get advice. Duty to pay allowances as the Welsh Ministers determine.
Schedule 12: Section 33 Arrangements: Transfer of Staff: - Schedule 12, paragraphs 2 and 4: Power by order to transfer to the transferee any specified description of employees of the transferor after consultation with employees.
Schedule 13: Further Provision about Standing Advisory Committees: - Schedule 13, paragraph 2: Duty to appoint a secretary to each standing advisory committee.
- Schedule 13, paragraph 3: Power to approve standing advisory committees.
- Schedule 13, paragraph 8: Power to make such payments in respect of expenses incurred by a standing advisory committee as they may determine.
- Schedule 13, paragraph 9: Power to pay to the members of a standing advisory committee, or a sub-committee of a standing advisory committee, such travelling and other allowances, including compensation for loss of remunerative time, as they may determine.
- Schedule 13, paragraph 10: Power to determine conditions relating to payments under this Schedule.

Schedule 14: Further Provision about Advisory Committees for Wales: - Schedule 14, paragraph 1: Duty to recognise a committee if the Welsh Ministers are satisfied that several prescribed contions are met.
- Schedule 14, paragraph 2: Power to withdraw recognition by notice in writing.
- Schedule 14, paragraph 4: Power to defray such expenses incurred by a committee in performing the duty imposed on it by paragraph 3 as the Welsh Ministers consider reasonable, and those expenses may include travelling and other allowances and compensation for loss of remunerative time.
Schedule 15: Further Provision about Local Services Authorities: - Schedule 15, paragraphs 1 and 2: Power to approve of or to give direction for local social services to enter and make arrangements for the care of pregnant women and women who are breast feeding (other than for the provision of residential accommodation for them). Power to make regulations as to the use of certain premises for certain purposes.
The following functions are exercisable solely by the Assembly in relation to Wales:- section 157(2): Power to annul a statutory instrument made by the Welsh Ministers under Part X (Protection of NHS From Fraud and Other Unlawful Activities), except for one made under s.144(6).
- section 157(3): Power to approve a draft SI made by the Welsh Ministers under section 144(6).
- section 203(4) and (5): Power to annul a statutory instrument made by the Welsh Ministers under this Act except one made under section 18, Schedule 3 and paragraph 1(1) of Schedule 4.
- section 203(6): Power to approve a draft Order made under section 141(4).
