Tribunals, Courts and Enforcement Act 2007 (c.15) OPSI - Tribunals, Courts and Enforcement Act 2007 (c.15)
to make provision about tribunals and inquiries; to establish an Administrative Justice and Tribunals Council; to amend the law relating to judicial appointments and appointments to the Law Commission; to amend the law relating to the enforcement of judgments and debts; to make further provision about the management and relief of debt; to make provision protecting cultural objects from seizure or forfeiture in certain circumstances; to amend the law relating to the taking of possession of land affected by compulsory purchase; to alter the powers of the High Court in judicial review applications; and for connected purposes.  

Functions exercisable solely by WAG or the National Assembly for Wales.

The following Ministerial functions are exercisable by the Welsh Ministers in relation to Wales:
  • section 136: Power to approve institutions as relevant museums and galleries. Power to withdraw such approval.

Schedule 7: Administrative Justice and Tribunals Council:

  • schedule 7, paragraph 7: Power to appoint some members of the Welsh Committee of the Administrative Justice and Tribunals Council.
  • schedule 7, paragraph 8: Duty to nominate the Chairman of the Welsh Committee.
  • schedule 7, paragraph 9: Power to remove Committee members on the ground of inability or misbehaviour.
  • schedule 7, paragraphs 14 and 15: Power to refer matters to the Council.
  • schedule 7, paragraph 17: Duty to lay before the National Assembly for Wales every report made by the Council to them under this paragraph.
  • schedule 7, paragraph 19: Duty to lay before the National Assembly for Wales every report made by the Welsh Committee to them under this paragraph.
  • schedule 7, paragraph 21: Duty to lay before the National Assembly for Wales annual reports.

Power by order to provide for a tribunal to be a listed tribunal for the purposes of this Schedule if, or to the extent that, the tribunal is one for which the authority is responsible. Power subject to negative resolution procedure. Definition in paragraph 27. See also shared powers.

The following Ministerial functions are exercisable by the Welsh Ministers after consultation with the Council in relation to Wales:
  • schedule 7, paragraph 24: Power to make, approve, confirm or concur in procedural rules for any listed tribunal.
The following Ministerial functions are exercisable by the Assembly in relation to Wales:
  • section 49(10):: A statutory instrument that contains an order made by the Welsh Ministers under paragraph 25(2) of Schedule 7 is subject to annulment in pursuance of a resolution of the National Assembly for Wales.
