Local Government and Public Involvement in Health Act 2007 (c.28) OPSI - Local Government and Public Involvement in Health Act 2007 (c.28)
to make provision with respect to local government and the functions and procedures of local authorities and certain other authorities; to make provision with respect to persons with functions of inspection and audit in relation to local government; to establish the Valuation Tribunal for England; to make provision in connection with local involvement networks; to abolish Patients' Forums and the Commission for Patient and Public Involvement in Health; to make provision with respect to local consultation in connection with health services; and for connected purposes.  

Functions exercisable solely by WAG or the National Assembly for Wales.

The following Ministerial functions under this Act are exercisable solely by the Welsh Ministers in relation to Wales namely:

See Representation of the People Act 1983, Local Government Act 2000 and other amended Acts.

Part 11: Joint Waste Authorities:

  • sections 205 and 210: Power by regulations to make provision for the contents and information accompanying a proposal for joint waste authorities.
  • sections 207 and 210: Power to implement with or with modification proposals for joint waste authorities. Power to give effect to schemes for thw winding-up, transfer or dissolution of an authority.
  • section 210 and Part 17: Power to make modifications to sections 205-208. Power to make consequential provisons etc. Power subject to negative resolution procedure.

Part 12: Entities Controlled by Local Authorities:

  • sections 212 and 214: Power to make order regulating (a) all Welsh local authorities; (b) Welsh local authorities of particular descriptions; (c) particular Welsh local authorities. Power to require consent of the Auditor General for Wales.
  • section 215: Power to issue directions for exemptions froms orders.
  • section 218: Power to define terms contained in enactments amended by the 2007 Act. Power subejct to negative resolution procedure.
  • section 245: Power to commence some provisions of the Act.
The following Ministerial functions under this Act are exercisable solely by the Welsh Ministers in relation to Wales namely:
  • section 240: Power to annul SIs made by the Welsh Ministers under sections 210 and 218. Power to approve draft SIs made by the Welsh Ministers under section 210 when it amends an enactment and under 212.
