NHS Redress (Wales) Measure 2008 (2008 nawm1) OPSI - NHS Redress (Wales) Measure 2008 (2008 nawm1)
to make provision about arrangements for redress in relation to liability in tort in connection with services provided as part of the health service in Wales; and for connected purposes.  

Functions exercisable solely by WAG or the National Assembly for Wales.

The following Ministerial functions are exercisable solely by the Welsh Ministers in relation to Wales:
  • sections 1 and 2: Power of Welsh Ministers to make regulations in respect of NHS redress
  • section 3: Power of Welsh Ministers to make regulations iabout accessing NHS redress
  • section 4: Power to impose a duty to consider the potential application of redress arrangements.
  • section 5: Power of Welsh Ministers to make regulations in respect of the method of delivering redress.
  • section 6: Power of Welsh Ministers to make regulations in respect of calculating the limitation period of liability.
  • section 7: Power of Welsh Ministers to make regulations in respect of the provision of legal advice and services of medical experts.
  • section 8: Duty to provide assistance for individuals seeking redress. Power to make arrangements or payments.
  • section 9: Power to decide whether and which functions could be exercised by the health service with regard to the operation of redress arrangements under this Measure. Power to impose conditions. Power to issue guidance.
  • sections 11 and 12: Transitional and supplementary powers.
  • section 14: Power to commence the Measure.
The following Ministerial functions are exercisable solely by the Welsh Ministers in relation to Wales:
  • section 11(4): Power of the Assembly to annul any SI made by the Welsh Ministers under this Measure subject to section 11(6) below.
  • section 11(6): Power of the Assembly to approve any draft statutory instrument made by the Welsh Ministers which: (a) contains regulations made by the Welsh Ministers under section 12 which amend or repeal any part of the text of an Act of Parliament or an Assembly Measure, or (b) contains the first regulations under section 1(1), or (c) contains regulations making provision under section 1(4)(b), section 1(5), section 3 or section 5, or (d) contains the first regulations to make provision under sections 2, 4, 6, 7 or 9.
