The following Ministerial functions under this Act are exercisable solely by the Welsh Ministers in relation to Wales:- section 6
- section 6A: Duty to prepare and publish biosecurity guidance in relation to foot-and-mouth and any other disease the Secretary of State specifies; power and duty to amend, review or revise such guidance.
- section 12: Export quarantine stations
- section 13(2): Orders as to dogs: Orders to regulate the wearing of collar by dogs, prevention, offence committed by dogs, seizure, detention and disposal.
-section 14A(1)(b): Power to specify any other disease for which a contingency plan should be established.
- section 14B: Duty to consider the are the most appropriate means of preventing the spread of the foot-and-mouth disease; duty to consider vaccination as such a mean.
- section 16A: Power by order to authorise or require the slaughter of vaccinated animals or the payment of compensation.
- section 28A and Schedule 2A: Power to amend Schedule 2A (Specified Diseases).
- section 22(1) and (7)(b): Power of entry etc. for section 21.
- section 30: Provisions supplemental to section 29.
- section 32A, 32C and 32D: Power by order to amend Schedule 3 for the purpose of authorising or requiring slaughter or the payment of compensation.
- section 32B: Duty of the Secretary of State to prepare the Disease control (slaughter) protocol.
Part 2A: Power of the Secretary of State relating to Scrapie. - section 36A and 36C: Power to specify sheep genotypes and to impose restrictions on breeding from genetically susceptible sheep.
- section 36B: Power to regulate for the identification of genetically susceptible sheep.
- section 36D: Power to make regulations about appeals against a restriction notice.
- section 36E: Power of enforcement.
- section 36K: Duty to make regulations providing for the payment of compensation for loss and costs incurred as a result of the exercise of this Part.
- section 48(b)(i): Certificates.
- section 41: power to authorise export of ponies in specified circumstances
- section 50(4): Local authorities for the purpose of this Act
- section 54(3)(b) and (6): Provisions of wharves etc.
- section 55(1)(b) and (c)(ii): Power to acquire land.
- section 59: Default.
- section 62D: Power to specify which disease (alongside with foot-and-mouth) should be tested and sampled giving a power of entry to a veterinary inspector.
- section 64: Power to authorise use of powers of inspectors as to poultry
- section 65: Power to detain vessels and aircraft: power to issue directions
- section 65A: Power to designate areas and periods for the inspection of vehicles.
- section 81: Report to Ministers.
- section 82: Information from agricultural Marketing Board.
- section 86: Ministers and their functions - interpretation.
- section 91(1), (2) and (3): Orders etc.
- Schedule 3, paragraph 3: Power to cause slaughter of animals because of foot-and-mouth disease.
The Ministerial functions relating to section 21, so far as it is applicable in relation to brucellosis, tuberculosis, dourine or infestation with maggot of the warble fly, and any other provision so far as it is applicable in relation to brucellosis, brucellosis melitensis, tuberculosis or infestation of cattle with the maggot of the warble fly are execisable by the Welsh Ministers in relation to Wales. |
