Food Safety Act 1990 (C. 16) OPSI - Food Safety Act 1990 (C. 16)

To provide for the protection of food for human consumption.  

Functions exercisable solely by WAG or the National Assembly for Wales.

The following Ministerial functions under this Act are exercisable solely by the Welsh Ministers in relation to Wales namely:
  • section 1: Power to prescribe types of ships or aircraft for the purpose of the definition of "premises" under the Act.
  • section 2: Power to prescribe meaning of "sale" of food.
  • section 6: Power to assume functions of an enforcement authority under the Act.
  • section 13: Power to issue emergency control orders to prohibit the carrying out of operations relating to food.
  • section 16 and schedule 1: Power to make Regulations relating to the fitness of food for human consumption.
  • section 17: Power to make regulations relating to food to implement Community obligations as defined in the European Communities Act 1972.
  • section 18: Power to make regulations relating to food or food sources not previously consumed in Great Britain.
  • section 19: Regulations for the licensing of food premises.
  • section 27(2): Power to prescribe qualifications of public analysts.
  • section 31: Regulations for sampling or analysis of food.
  • section 40: Power to issue code of practice to guide food authorities. Agency to consult the Welsh Ministers before its issues a compliance direction and before it makes an application under (3). Power of the Welsh Ministers in relation to consultation by the Agency.
  • section 41: Power to require returns
  • section 42: Default powers in relation to food authorities.
  • section 45: Power to regulate charges.
  • section 48: regulations and orders- ancilllary powers. Duty to have regards to advice of Food Standards Agency.
  • section 49: Power to prescribe form of documents.
  • section 59: Power by order to modify local Acts and subordinate legislation expedient or necessary in consequence of the Act.
