Cardiff Bay Barrage Act 1993 (C. 42) OPSI - Cardiff Bay Barrage Act 1993 (C. 42)
To establish and maintain a barrage across the mouth of Cardiff Bay and to make provision for the operation of the barrage and for property damaged by groundwater levels.  

Functions exercisable solely by WAG or the National Assembly for Wales.

The following Ministerial functions under this Act are exercisable solely by the Welsh Ministers in relation to Wales namely:
  • section 4: Power to confirm compulsory purchase of land for the barrage.
  • section 16: Power to confirm, with or without modifications, byelaws made by the Development Corporation for the inland bay and outer harbour.
  • section 17: Power to direct that Development Corporation shall be a harbour authority for any enactment.
  • section 20: Power to direct membership of the Cardiff Bay Advisory Committee which is established to advise the Development Corporation about the operation of the barrage and management for the inland bay.
  • section 21: Power to amend Schedule 7 to the Act relating to provisions about damage to property from alteration of groundwater levels.
  • section 23: Power to make Regulations to protect the interests of any persons or bodies who are affected by the exercise of the powers of the Development Corporation under the Act.
  • Schedule 3 paragraph 4(d): Approval of fish passes placed in rivers by the Development Corporation
  • Schedule 3 paragraph 7(1): Determination of disputes between the Environment Agency and the Development Corporation about matters relating to fish or works or operations in rivers.
  • Schedule 7 paragraph 5(b)(ii): Authorisation to place or remove apparatus from buildings owned by statutory undertakers.
  • Schedule 7 paragraph 27: Appointment of Independent Groundwater Complaints Administrator to consider complaints about the exercise of the Development CorporationĘs functions under Schedule 7.
