Transport and Works Act 1992 (C. 42) OPSI - Transport and Works Act 1992 (C. 42)
To provide for the making of orders relating to the construction or operation of railways, tramways, trolley vehicle systems and other guided transport systems and inland waterways.  

Functions exercisable solely by WAG or the National Assembly for Wales.

The following Ministerial functions are exercisable solely by the Welsh Ministers in relation to Wales under this Act:
  • section 1: Orders relating to, or matters ancillary to the construction or operation of a railway, tramway, trolley vehicle system or prescribed mode of guided transport (unless the order has effect both in Wales and England). See also shared powers
  • section 3: Orders relating to the construction or operation of an inland waterway (unless the order has effect both in Wales and England).See also shared powers.
  • section 6-14: Procedure for making orders (except the order, rule and Regulation- making powers in sections 6 (2) to (6), 7(1)(a) and 4, 8 and 10- and the functions vested in a "Minister of the Crown" under section 9(4) and (5)- see also Shared powers
  • section 23: Power to prescribe classes of application which are to be dealt with by a person appointed by the Secretary of State , instead of by the Secretary of State.
