Welsh Development Agency Act 1975 (C. 70)
To establish and maintain a Welsh Development Agency and a Welsh Industrial Development Advisory Board.  

Functions exercisable solely by WAG or the National Assembly for Wales.

The following Ministerial functions under this Act are exercisable solely by the Welsh Ministers in relation to Wales namely:
  • sections 1(8) and (9): Power to direct Agency as to the exercise of its functions.
  • section 2 and Schedule 1: Power to appoint chairman, deputy chairman and other Board members and approve appointment of the chief executive.
  • section 10: Authorisation for Agency to provide means of access or other services or facilities for the development of industry in an area.
  • section 10A: Power to appoint with the Treasury approval the Agency to act agent of the Secretary of State in relation to providing financial assistance for regeneration and development under sections 126-128 of the Housing Grants, Construction and Regeneration Act 1996 and sections 27 to 29 of the Housing and Planning Act 1986.
  • section 13: Appointment of members of the Welsh Industrial Development Board to advice the Secretary of State as to the exercise of his functions under section 7 of the Industrial Development Act 1982.
  • section 15: Approval, with Treasury approval, for the making of payments by the Agency to bodies undertaking the improvement of the environment in Wales.
  • section 16: Power to consent to the Agency: (a) paying grants, at 80% or such other percentage prescribed by the Secretary of State with the Treasury consent, to persons to reclaim or improve derelict, unsightly or neglected land; (b) acquiring such land compulsorily or by agreement; (c) carrying out works on such land.
  • section 17: Determination, with Treasury approval, of the financial duties of the Agency.
  • section 18: Power by order to approve limit of borrowing by the Agency.
  • section 19(7): Power to direct that Agency is not bound by the provisions of sections 19(5) and (6) in relation to shareholdings in bodies carrying on a business of publishing newspapers or magazines.
  • section 20: Power to consent to limit of purchase of share capital by the Agency or its subsidiaries.
  • section 21A, Schedule 4 and 21B: Consent to compulsory purchase of land or disposal of land by Agency.
  • section 23: Power to permit entry onto land to carry out surveys for the purposes of the Act.
