The following Ministerial functions under this Act are exercisable solely by the Welsh Ministers in relation to Wales namely: Baseline Assessments: Repealed. Pupils Performance: - section 19: Provision by Regulations to require governing bodies of maintained schools to set annual targets in respect of the performance of pupils in public examinations.
Supervision of Curriculum for Schools and External Qualifications: The Qualifications and Curriculum Authority: - section 25: Power to obtain advice from and give further functions to the authority. Power to designate persons to be supplied with information by the Authority.
The Qualifications, Curriculum and Assessment Authority for Wales: - section 27: Appointment of members by the Secretary of State.
- sections 28 and 31: Power to obtain advise from the authority, including advise about education and training and to give it further functions. Power to designate persons to be supplied with information by the Authority.
- section 30: Power to obtain advice about external qualifications.
- section 32 and 32A: Power to give authority directions.
The functions of the Secretary of State under section 36 are transferred so far as relating to the Qualifications, Curriculum and Assessment Authority for Wales. - section 36: Secretary of State may by regulations provide for a levy on bodies awarding qualifications accredited by relevant authority ( this includes the Qualification Curriculum and Assessment Authority for Wales).
Control of Certain Courses leading to External Qualifications - section 37: Provision by Regulations for approval by the Secretary of State or a designated body of a course leading to an external qualification.
- section 38: Power to require Chief Inspector of Schools in Wales to inspect a local education authority.
Careers Guidance: - section 46: Power by Regulations to extend the operation of sections 43, 44 or 45 (giving of career guidance) to primary schools.
Qualifications, Curriculum and Assessment Authority for Wales: - Schedule 5, paragraph 4: Power to determine terms and conditions of appointment of chief officer and make him a member of the authority.
- Schedule 5 paragraph 6: Power to remove a member.
- Schedule 5 paragraph 8: Determination of fees and allowances to members.
- Schedule 5 paragraph 9: Approval of terms, conditions and numbers of authority staff.
- Schedule 5 paragraph 11: Power to pay grants for Authority's expenditure.
- Schedule 5 paragraph 12: Power to require establishment of committees.
- Schedule 5 paragraph 13: Power to authority delegation of functions to a committee.
