| To make provision for local authority functions with regard to higher and further education; to reorganise the provision of higher education. |

Functions exercisable solely by WAG or the National Assembly for Wales. |
The following Ministerial functions under this Act are exercisable solely by the Welsh Ministers in relation to Wales namely:- section 120: Power to amend Schedule 6 to the Act - Courses of education not to be provided by local authorities as part of the facilities for higher education.
- section 121: Orders incorporating institutes of higher education as body corporate separate from local authorities.
- section 122A: Order transferring further education corporations to the higher education sector.
- section 124C: The Secretary of State to be the appointing authority relating to the initial appointment of a further or higher education corporation.
- section 126: Power to appoint transfer date of property to a higher education corporation.
- section 128: Power to dissolve higher education corporations.
- section 129: Power to designate institutions to receive grants from a higher education funding council.
- section 156: Power to direct amendment of memorandum or articles of association of designated assisted institutions providing full-time education.
- sections 158 and 159: Power to require reports, returns and information from the governing body of local authority further or higher education institutions and to require the giving of prescribed information in relation to such institutions.
- section 214: Power to designate recognised award of a degree.
- section 216: compilation of lists of recognised bodies for the purpose of giving degrees.
- section 219: Power to determine disputes and to prevent the unreasonable exercise of functions at further and higher institutions maintained by local education authorities.
