To provide for the creation of the General Teaching Council for Wales; to provide for the registration, qualifications and training of teachers; and for professional headship qualifications to make provision for grants and loans to students in higher and further education and for fees payable by them.  

Functions exercisable solely by WAG or the National Assembly for Wales.

The following Ministerial functions are exercisable solely by the Welsh Ministers in relation to Wales namely:

Sections 10, 11, 13 repealed. Power to create the Council and to make regulations relating to the Council and the duty of the Council to advise the Welsh Ministers regarding matters such as teaching standards; Power to introduce a new category of provisional registration of teachers; section 4A: Powers relating to appeals against refusal of registration; Power by order to amend certain provisions of schedule 1 with a view of removing or relaxing the controls over the GTC.

Part 1 Chapter 2 Secretary of State to determine a professional headship qualification; section 18 repealed.

Part 1 Chapter 3 Secretary of State's duty relating to teacher training for example to set standards of induction period; or the information to be supplied following dismissal, resignation etc., or by a contractor agency, &c.

  • section 22: Regulations to make provision for giving grants or loans to students, except so far as they relate to the making of any provision authorised by subsection (2)(a), (c), (j) or (k), (3)(e) or (f) or (5) of that section. See no powers and shared powers.
  • section 23: Powers relating to the transfer or delegation of functions relating to student support so far as they relate to functions which are exercisable by the Welsh Ministers under regulations under section 22.
  • section 25: Power to make regulations relating to transitional provisions, so far as it relates to the power to make discretionary awards under the Education Act 1962 (c.12).
  • section 28(1)(e) fees: in respect of attendance on course, including admission, registration, tuition and graduation fees so far as it relates to sections 22 (Secretary of State's power to make grants to students attending higher and further education) and 26 ( see above);

Part IV Secretary of State may request the inspection of vocational training by HM Chief Inspector of Schools in Wales.

  • section 35: Power to issue instructions and guidelines relating to the inspection of careers services in Wales. Power to arrange for the publication of inspection reports.
