The following Ministerial functions under this Act are exercisable solely by the Welsh Ministers in relation to Wales namely: Part I: Dark smoke: - sections 1 and 2: Regulations excluding smoke from prohibition of emissions from chimneys and from industrial or trade premises.
- section 3: Regulations to ascertain what is dark smoke.
Part II: Smoke, Grit, Dust and Fumes: Regulations may be made in respect of: limits on the rates of emission of grit and dust from furnace chimneys and outdoors furnaces; excemptions for specified classes of furnaces; prescribing method of measurements of emissions and recording apparatus; prescribing purposes for exempted boilers or plant. Appeals: Appeals against decisions not to approve arrestment burning plant appeals against refusal to approve height of a chimney. Approval: Height of chimneys Part III: Smoke Control Areas: Powers: requiring creation of smoke control areas; contribution to local authoritiesÆ expenditure on giving grants for adaptation of fireplaces. Regulations and Orders: authorisation of fuel; exemptions of classes of fireplace; exemptions for certain areas; exemptions for specified classes of buildings Part V: Information about Air Pollution: - section 37: Appeal against requirement to give information.
- section 38: Regulations requiring local authorities to perform their functions under Part V in prescribed manner.
- section 39: Requirement for local authorities to give information to the Secretary of State.
Part VI: Special Cases: - section 45: Appeal where local authority refuses to exempt research from provisions of the Act.
Part VII: Miscellaneous: Regulations can apply certain sections of the Act to fumes and prescribed gases. - section 60: Default powers.
