Countryside Act 1968 (C. 41)
To enlarge the functions of the Countryside Council for Wales and make other provision as regard the countryside.  

Functions exercisable solely by WAG or the National Assembly for Wales.

The following Ministerial functions under this Act are exercisable solely by the Welsh Ministers in relation to Wales namely:

Countryside Council for Wales:

  • section 2: Power to refer matters for consideration to the Council
  • section 4: Power to authorise Council to purchase land by agreement or compulsorily for experimental projects or techniques or, with the Treasury consent, to approve the purchase of any business.

Local Authority Powers:

  • sections 8(4) and 12(5): Power to direct local authorities to consult with bodies in matters relating to the sea or inland waters.
  • section 11: Duty to have regard to conservation of natural beauty.
  • section 16(8): Duty to consult with the National River Authority before making an access order adjacent to a river.
  • section 41: Power to confirm byelaws about local authority country park wardens and picnic sites.
  • section 44: Power to amend local Acts to make then consistent with the 1968 Act.
  • Schedule 1: Power in relation to proposals submitted to statutory undertakers and other authorities in relation to provision by a local authority of country parks or other facilities.
  • Schedule 2: Power to confirm compulsory purchase of land by a local authority for purposes under section 9 of the Act for providing public facilities on or near common land.
