Environment and Safety Information Act 1988 (C. 30) OPSI - Environment and Safety Information Act 1988 (C. 30)
To establish public registers of certain notices served concerning health, safety and environmental protection.  

Functions exercisable solely by WAG or the National Assembly for Wales.

The only Ministerial functions are exercisable solely by the Welsh Ministers in relation to Wales in respect of

(a) "the responsible authority" function under section 2(2)(d) in relation to any individual employed and authorised by the Welsh Ministers; and

  • section 2(2)(d): any bodies corporate authorised pursuant to section 19(1) of the Food and Environment Protection Act 1985 and where an individual is so authorised, the responsible authority in relation to any notices served by him shall be the Secretary of State

(b) "the appropriate Minister" function under section 4 in relation to any notice served by the Welsh Ministers.

  • section 4: a person on whom a notice has been served gives written notification to the authority that the making of an entry on the register in relation to the notice would disclose information about a trade secret or secret manufacturing process, and where the authority subsequently draft an entry, the person affected may appeal to the appropriate minister by written notice within fourteen days; the Minister may determine the terms of the entry.
