Food and Environment Protection Act 1985 (C. 48)

To make orders in emergency specifying activities which are to be prohibited as a precaution against unfit food for humane consumption and to make provision for depositing articles on the sea-bed.  

Functions exercisable solely by WAG or the National Assembly for Wales.

The Ministerial functions under this Act which are exercisable solely by the Welsh Ministers in relation to Wales are:
  • section 2(1): Power to permit anything which is otherwise prohibited by an emergency order.
  • section 2(3): Power to issue directions to prevent human consumption of food.
  • section 18(1): Power to require payment of a fee for approving a pesticide under regulations made under section 16 (control of pesticides).
  • section 19 and Schedule 2: Power to authorise enforcement of control of pesticides.

Other Ministerial functions which are exercisable by the Welsh Ministers in relation to Wales are set out in the No powers section.

CONCLUSION: The powers under Part II are exercisable solely by the Welsh Ministers in relation to Wales except so far as they are exercisable in relation to matters concerning or arising from the exploration for, or production of petroleum.
