Improvement of Land Act 1864 (C. 114)

To make provision in respect of loans advanced by private individuals for land improvement.

The Ministerial functions under this Act which are exercisable solely by the Welsh Ministers in relation to Wales are in respect of the functions transferred from the Minister of Agriculture, Fisheries and Food to the Secretary of State by the Transfer of Functions(Wales)No 1 Order 1978-SI.1978/272 article 2(1) and Schedule 1. The Act as read with the Order provides that on application being made to the Secretary of State by landowners, for proposed improvements as defined in section 9 of the Act, sanction may be given by means of a provisional order so that often the execution of the sanctioned improvements, the landowner is entitled to an absolute order, signed by the Secretary of State which creates a charge in fee simple on the land improved (section 68 ) Provision is also made for the Secretary of State to apportion or release such charges (section 69) and their enforcement by the Secretary of State.
