The following Ministerial functions under this Act are exercisable solely by the Welsh Ministers in relation to Wales namely:- section 3: Power to make order in relation to an area of special protection against destroying or interfering with wild birds in the area.
- section 5: Power to amend section 5(1) to specify by adding protected wild birds and adding or amending way method of their killing.
- section 6: Regulations for licensing of persons to sell live or dead wild birds and eggs. Power by regulations to provide for the ringing and marking of birds to be included in Part I of Schedule 3.
- section 7 and Schedule 4: Regulations relating to the keeping of prescribed wild birds including power to charge.
- section 11: Power by order to apply provisions of an international obligation by amending sections 11(1) and (2) relating to the prohibition of certain methods of killing or taking wild animals.
- section 14: Power to authorise entry onto land to ascertain existence of certain wild animals or plants.
- section 14ZA: Power to prescribe by order animals or plants forbided to be sold, possessed or transported in the UK as invasive non-native species.
- section 14ZB: Power to issue or approve codes of practice in connection with invasive non-native species. Power to revise or replace such codes. Duty to publish them.
- section 18A: Power to authorise Wildlife inspections and specify conditions and limits.
- section 19ZA: Power to authorise wildelife inspectors.
- section 22: power to vary Schedules 1 to 4 of the Act in relation to any bird, and to add to or remove from Schedule 5 or Schedule 8 any animal or plant.
- section 23: Power to establish advisory bodies and to pay them.
- section 28F: Power to determine and regulate appeals in connection with consents. Power to quash or affirm stop notices.
- section 28G: Genral duty to take reasonable steps, consistent with the proper exercise of the Welsh Ministers's functions, to further the conservation and enhancement of the flora, fauna or geological or physiographical features by reason of which the site is of special scientific interest.
- section 28H: Duty to give notice to the Nature Conservancy Council before carrying out functions likely to damage flora and fauna or geological or physiographical features by reason of which a site of special scientific interest is of special interest.
- section 28I: Before permitting the carrying out of operations likely to damage any of the flora, fauna or geological or physiographical features by reason of which a site of special scientific interest is of special interest, duty to give notice of the proposed operations to the Nature Conservancy Council.
- section 28L: Power to determine and regulate appeals relating to management notices.
- sections 32 and 41: Duty in giving farm capital grants to further the conservation of flora, fauna and special features in areas of special scientific interest and in National Parks and other specified areas.
- sections 33 and Schedule 11: Power to prepare codes of guidance relating to areas of special scientific interest.
- section 34: Power by order to designate land a subject to a limestone pavement order prohibiting the removal or disturbance of limestone.
- section 35: Power to confirm byelaws in relation to national nature reserves.
- sections 36, 37 and Schedule 12: Power to designate a marine nature reserve and to confirm byelaws in relation thereto.
- section 45: Power to vary orders designating National Parks.
- section 47: Power to give grants to the Countryside Council for Wales.
- section 53A: Power to include modifications in other orders.
- section 53B: Power to make regulations for the making and keeping of a register of applications under section 53.
- section 54A: Power to make regulations relating to BOATs not to be added to definitive maps.
- section 56: Power to determine the date for section 53A orders. Power to make regulations relating to surveying authorities.
- section 59: Power to add to or amend recognised dairy breeds for the purposes of the section (prohibition of keeping bulls on land crossed by public rights of way).
- Schedule 10A: Power to revoke arrangement for delegation of appeal functions under sections 28 F and 28L.Power to direct the holding of an inquiry in connection with the appeal or matter. Power to appoint assessor.
- Schedules 14 and 15: Appeal provisions with public right of way orders.
