The following Ministerial functions are exercisable by the Welsh Ministers concurrently with the Secretary of State:- section 29(1): Agreed audit of accounts. The Commission may, with the consent of the Welsh Ministers and by agreement with the body concerned, undertake the audit of the accounts of any body which appears to the Welsh Ministers to be connected with local government or the National Health Service; and is not a body subject to audit. Power to notify any person of, or publish in any manner a consent given or any matter relating to the consent.
Other provisions:Section 32(1) and (2) shall, in relation to a police authority established for a police area in Wales, have effect as if the references to "the Secretary of State" included reference to the Welsh Ministers. The function of the Comptroller and Auditor General under section 33(5) and (6)(c) shall, in relation to a health service body in Wales specified in Part II of Schedule 17 to the Government of Wales Act 1998, be exercisable also by the Auditor General for Wales. - section 32(1) and (2): Documents relating to police authorities etc. The Commission shall send to the Secretary of State a copy of any report of which any copy is sent to the Commission under section 10 (2) Transmission and consideration of immediate and other reports in public interest- and which relates to- a police authority established under section 3 of the Police Act 1996 or the Service Authority for the National Crime Squad.
If it appears to the Commission appropriate to do so, it may send to the Secretary of State a copy of any document which relates to one or more police authorities established under section 3 of the Police Act 1996 and has been sent by the Commission to such an authority, or relates to the Service Authority for the National Crime Squad and has been sent by the Commission to that authority. - section 33(5): Studies for improving economy etc. in service. The Commission shall publish or make available its recommendations and the result of any studies and in case of studies relating to a health service body, shall ,on, request provide the Comptroller and Auditor General with all material relevant to the studies.
- section 33(6)(c), (ca), and (f): Before undertaking or promoting any study under this section (other than 2(a) and (b)) the Commission shall in the case of any health service bodies, also consult the Welsh Ministers and the Comptroller , Auditor General , and the Auditor Genral for Wales; and in the case of any other study relating to a body in respect of which the Welsh Ministers may exercise functions, consult the Welsh Ministers.
Part II of Schedule 17 to the Government of Wales Act 1998: Section 34(2) to (6) shall, in relation to reports prepared under section 34(1) on the provision of services in Wales or the financial management of a body exercising functions in Wales, have effect as if references to the Comptroller and Auditor General included a reference to the Auditor General for Wales but so that the provision under section 34(5) for laying a report before the House of Commons were, in relation to the Auditor General for Wales, a provision for laying a report before the Welsh Ministers. - section 34: Reports on impact of statutory provisions etc. Duty to consult the Welsh Ministers (6)(da).
Section 49(1)(c) shall have effect as if the reference to "the Secretary of State" included a reference to the Welsh Ministers and as if the reference to "the Comptroller and Auditor General" included a reference to the Auditor General for Wales. - section 49(1)(c): No information relating to a particular body or other person and obtained by the Commission or an auditor, or by a person acting on behalf of the Commission or an auditor, pursuant to any provision of this Act or in the course of any audit or study under any such provision shall be disclosed except- ... in the case of a health service body, for those purposes or for the purposes of the functions of the Secretary of State and the Comptroller and Auditor General under the National Health Service Act 1977.
Paragraphs 11(4) and 14(2) of Schedule I, so far as they provide for the laying of documents before Parliament, shall have effect as if they also provided for the laying of such documents before the Welsh Ministers. - Paragraphs 11(4) of Schedule 1: The Comptroller and Auditor General shall examine and certify the statement of account transmitted to him under sub-paragraph (3) and shall lay before Parliament copies of the statement together with his report on it. sub-paragraph (3): The Secretary of State shall, on or before 31st March in each year, transmit to the Comptroller and Auditor General the statement of account prepared by the Commission for the financial year last ended.
- Paragraphs 14(2) of Schedule 1: Copies of each annual report shall be sent by the Commission to the Secretary of State who shall lay copies of it before each House of Parliament.
The following Ministerial function is exercisable by the Welsh Ministers after consultation with the Commission and persons appearing to represent registered social landlords- section 41B: Power to make an order authorising the Commission to charge fees for inspection under section 41A.
The following Ministerial functions are exercisable by the Secretary of State with the agreement of the Welsh Ministers:The functions of the Secretary of State under section 1(2) and under paragraph 4(4) of Schedule 1 shall be exercisable only with the agreement of the Welsh Ministers so far as necessary to ensure that, at all material times, one of the persons appointed as a member of the Commission shall have been appointed with the agreement of the Welsh Ministers. - section 1(2): Power to appoint members of the Audit Commission.
- paragraph 4(4) of Schedule 1: power to remove a member from office if that member-- (a) has become bankrupt or made an arrangement with his creditors; (b) is incapacitated by physical or mental illness; (c) has been absent from meetings of the Commission for a period of six months otherwise than for a reason approved by the Secretary of State; or (d) is in the opinion of the Secretary of State otherwise unable or unfit to discharge the functions of a member.
The following Ministerial functions are exercisable by the Secretary of State after consultation with the Welsh Ministers in relation Wales:- section 1(3): Duty to appoint one of the members to be chairman and another to be deputy chairman.
- paragraph 7(1) of Schedule 1: Power to approve the Commission's choice for the Controller of Audit.
- paragraph 11(1) of schedule 1: Power to direct the form of annual statement of accounts with the approval of the Treasury.
