The following Ministerial functions have not been devolved to the Welsh Ministers in relation to Wales:- section 1: The Audit Commission. There shall continue to be a body known as the Audit Commission for Local Authorities and the Nation Health Service in England and Wales. Power of the Secretary of State to appoint the Commission (15 to 20 members) and its chairman and deputy chairman. See also Shared powers.
- section 4: Code of Audit practice. The Commission shall sent copies of any codes it has prepared or any alterations to them, to the Secretary of State who shall lay them before Parliament.
- section 38: Benefit administration studies for Secretary of State but not in relation to a county council, county borough council or community council in Wales.
The Secretary of State may request the Commission to conduct or assist the Secretary of State in conducting studies designed to improve economy, efficiency, effectiveness and quality of performance in the charge by local authorities of functions relating to the administration of housing benefit and council tax benefit.
- section 39: The Commission may make social security references and reports to the Secretary of State in relation to any matter arising from an audit or study if it appears to be relevant for the purposes of any of the functions of the Secretary of State relating to social security.
- section 40(2): Studies relating to registered social landlords. Where the Housing Corporation and the Commission fail to agree a programme proposed by either of them, either of them may refer the matter to the Secretary of State who may direct that the programme be carried out either without modifications or with modifications specified in the direction.
- section 50: Supply of benefit information to Commission. The Secretary of State may supply to the Commission any information held by him which relates to housing benefit or council tax benefit and which appears to him to be relevant to the exercise of any function of the Commission.
