Acquisition of Land Act 1981 (C. 67)
To provide the procedure for the compulsory purchase of land.  

Functions exercisable solely by WAG or the National Assembly for Wales.

The following Ministerial functions under this Act are exercisable solely by the Welsh Ministers in relation to Wales namely:
  • section 5: Power to hold public local inquiries for the purposes of the Act.
  • section 5A: Power to require provision of information.
  • section 7(2): See: Powers shared below.
  • section 13, 13A, 13B, 13C: Power to confirm compulsory purchase orders submitted any local and other relevant authorities with or without modification. Power to prescribe the procedure for representations. Power to issue directions.
  • section 16: Power to certify that the land of relevant statutory undertakers can be compulsorily purchased.
  • section 19: Power to certify where land forming part of a common, open space, fuel or field garden allotment is proposed to be compulsorily purchased.
  • section 28 and Schedule 3: Power to certify that a right over land of relevant statutory undertakers can be compulsorily created.
  • section 29: Power to disregard certain objections in considering applications for the confirmation of compulsory rights order the Opencast Coal Act 1958.
  • Schedule 1: Procedure for the compulsory purchase of land by the Secretary of State.

The regulation-making function provided for in section 7(2) is only transferred so far as it is exercisable in relation to such orders as fall to be made or confirmed by the Welsh Ministers.

  • section 7(2): Anything which by Part II - Purchases by Local And Other Authorities - or Part III - Special Kinds of Land - or Schedule 1 - Purchases by Ministers- or 3 - Acquisition of Rights over Land by the Creation of New Rights - of this Act, is required or authorised to be prescribed shall be prescribed by regulations made by the Secretary of State by statutory instrument.
