Adoption Act 1976 (C. 36)

as amended by the Adoption and Children Act 2002 c.38. This Act has been repealed by the Adoption and Children Act 2002 with savings by Schedule 5.

To consolidate the legislation relating to adoption including the creation of local authority adoption services, making of adoption orders, the care and protection of children awaiting adoption and the status of adopted children.  

Functions exercisable solely by WAG or the National Assembly for Wales.

The only Ministerial functions under this Act exercisable solely by the Welsh Ministers in relation to Wales are:
  • section 9: Regulation of adoption agencies. Power of the appropriate authority to make regulations.
  • section 8: Inactive or defunct adoption societies. Direction given by the Secretary of State to local authorities.

sections 9 and 9A are to be treated as if exercisable by the Welsh Ministers by an Order in Council under section 22 of the GWA.

  • section 9A: Power to establish a procedure for independent review of determinations made by adoption agencies. Power to prescribe by regulations the description of determinations which are qualifying determinations. Powers relating to such reviews, their operation and maintenance. Power to delegate functions to organization and to direct such organisations.
  • section 28: Care and protection of children awaiting adoption: Restriction on removal where applicant has provided home for 5 years. By order, the Secretary of State may change the period of 5 years.
  • section 51A: Adoption Contact Register information about adopted persons and relatives, powers of the Registrar General.
  • section 57A: Permitted allowances. Power of the Secretary of State to make regulations enabling adoption agencies to pay allowances to persons who have adopted.
  • section 58A: Information concerning adoption duty on local authorities and adoption societies to send information to the Secretary of State.
  • section 65A: Panels for selection of guardians ad item and reporting officers established by regulation of the Secretary of State.
