Summary:

This Order brings into force paragraph 4 of Schedule 5 to the Enterprise Act 2002 for all remaining purposes. It therefore brings into force section 49(1)(b) of the Competition Act 1998 (as substituted by paragraph 4 of Schedule 5 to the Enterprise Act 2002). This provision provides a right of appeal against an award of damages by the Competition Appeal Tribunal (including a right of appeal against any amount awarded). A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.
