These Regulations further amend the Common Agricultural Policy (Wine) (Wales) Regulations 2001 ("the 2001 Regulations"), which provide for the enforcement in Wales of European Community Regulations concerned with the production and marketing of wine and related products.
These Regulations-
(a) replace references to the Wine Standards Board with references to the Food Standards Agency (regulation 2(1) to (3)) thereby making the Food Standards Agency responsible for the enforcement functions under the 2001 Regulations that were previously the responsibility of the Wine Standards Board;
(b) make other consequential amendments arising as a result of the changes made in relation to those enforcement functions (regulation 2(4) and (6));
(c) update the definition of "the Commissioners" in regulation 2(1) of the 2001 Regulations following the vesting of functions previously exercisable by the Commissioners of Customs and Excise in the Commissioners for Revenue and Customs (regulation 2(5)(a));
(d) update references to European Community legislation by making changes to the definitions in the 2001 Regulations (regulation 2(5)(b) and (c)), substituting a new Schedule 1 to the 2001 Regulations (regulation 2(7) and Schedule 1) and updating Parts III and Part V of Schedule 2 to the 2001 Regulations (regulation 2(8)(a) and (b) and Schedule 2);
(e) put in place a different procedure for the review of prohibitions etc on the movement of wine-sector products (regulation 2(7));
(f) correct an error in item 12 of the table set out in Part V of Schedule 2 to the 2001 Regulations (regulation 2(8)(c));
(g) add Gamay and Gewurztraminer to the list of vine varieties that may be used in the production of wines in Wales (regulation 2(9)); and
(h) contain transitional provisions (regulation 3).
