Ancient Monuments and Archaeological Areas Act 1979 (C. 46)
To consolidate the law relating to ancient monuments and to provide for the inspection and recording of matters of archaeological interest and to regulate such activities.

The following Ministerial functions under this Act are exercisable solely by the Welsh Ministers in relation to Wales namely:
  • section 1: Compilation of list of Schedule of monuments comprising buildings structures, sites or caves.
  • section 2: Consent to carry out works on scheduled monuments.
  • section 4: Power to modify or revoke scheduled monument consent.
  • section 5: Power to carry out urgent works to a scheduled monument.
  • section 6: Power of entry.
  • section 7: Duty to pay compensation to person who has suffered loss as a result of scheduling a monument.
  • section 8: Recovery of compensation.
  • sections 10, 11 and 15: Compulsory acquisition or by acquisition by agreement or gift of ancient monument and adjoining land.
  • sections 12 to 14: Power to place ancient monument under guardianship.
  • section 16: Acquisition compulsory or by agreement of easements over land in the vicinity of ancient monument.
  • section 17: Agreements with landowners about the ancient monuments and land in the vicinity.
  • section 19: Power to control times of access to monuments under public control.
  • section 21: Power to transfer ancient monuments to local authorities.
  • section 22: Power to appoint members to the Board.
  • section 24: Power to pay or contribute towards the acquisition costs of an ancient monument.
  • section 25: Power to give advice about ancient monuments.
  • section 30: Power to dispose of land acquired under the Act.
  • section 33: Designation of archaeological areas.
  • section 34: Appointment of persons to undertake archaeological investigations.
  • section 35(6): Regulations prescribing procedure where a developer serves an operations notice on a local authority.
  • section 37: Power to exempt from requirements to serve a section 35 operation notice.
  • sections 40 and 43: Power to enter onto land.
  • section 42: Consent to use metal detector in a protected place.
  • section 45: Power to undertake or to contribute to the cost of archaeological investigations.
  • section 46: Payment of compensation for damage caused by investigations.
  • section 49: Power to give grants to the Architectural Heritage Fund.
  • section 57: Power to require information about legal interests in land.
